Cancellations by client:

Prior to 14 days – 10% of the tour price

7 to 14 days – 30% of the tour price

2 to 6 days – 50% of the tour price

Within 48 hours & No-shows – 100% of the tour price

 

Cancellations by Simon’s Town Boat Company:

We reserve the right to cancel any tour/charter due to weather, safety, operational or for any other reason whatsoever.

A full refund (less bank & foreign exchange fees) will be reimbursed or no invoice will be rendered by us in such instances.

Our liability where applicable will only be limited to the price of our tour/charter and we do not cover any additional or consequential costs that may arise, such as transport, accommodation etc.

When making a booking within 24 hours of departure, please call us (083 257 7760) to check availability.

Upon the confirmation of any booking, it shall be regarded that the client has read and agreed to all the terms and conditions contained herein. All terms and conditions are subject to South African Law & Jurisdiction.

IMPORTANT:

As all our tours are weather dependent & forecasts aren’t always accurate, we will contact you on the day of your tour to confirm that we will be operating. Please ensure that we have your correct mobile number.

Should you not hear from us for any reason, please give us a call before departing to Simon’s Town.

Payment:

Please bring your credit card (or cash) along for payment, as we only charge you on the day of your tour.

Credit card details are only taken to secure your booking & will only be debited by us in terms of our cancellation policy or no-shows.

Sightings Guarantee: Whale watching only

Marine tours, just like safari game drives takes place in a wilderness environment where free ranging animals have no barriers or boundaries. We have an extensive spotter network, both on the land & at sea to maximize your chances of seeing whales or dolphins and are proud of our 90% plus success rate. However, in the unlikely event that you do not see a whale or dolphin on your tour, we offer a 15% goodwill refund.

This must be claimed from our office on return from your tour as a refund to your card, or by EFT to a South African bank account if paid by EFT. We do not make foreign bank payments due to exchange regulations & high bank charges.

Photography & filming during the tour:

We take photographs and videos during our tours that may be used for advertising, brochures, television screenings, etc.

Clients irrevocably give us their consent thereto, without any consideration being payable to them.

Rates:

Our tour & charter prices change periodically and the ruling price on the day of your tour/charter applies.

Passenger & Public Liability:

All vessels owned by us are covered by passenger & public liability insurance. Notwithstanding; passengers travel entirely at their own risk.

In the case of outsourced vessels, we act purely as an agent on behalf of the client and do not accept any liability for passenger or public liability claims that may arise. Full details of the service provider will be disclosed on request and it is the duty of the client to ensure that they are adequately covered. In the event that the service provider does not meet the client’s insurance requirements, we are to be notified timeously and will endeavor to find an alternative supplier.
